Eastbound and Beyond Terms of Service
By participating in any Eastbound and Beyond (“we”, “us”, “our” or “the Company”) activity, you agree to the following Terms, Conditions, Waiver, and Release of Liability on behalf of yourself and all individuals you have booked and paid for.
Payment
Eastbound and Beyond requires full payment at the time of booking via PayPal. This is the only way to guarantee your selected date and time. If any balance remains due at the start of your tour, it must be paid in cash before the tour begins.
Cancellation Policy
(1)Full Refund: Cancellations made at least 24 hours before the tour start time are eligible for a 100% refund. However, if payment was made via PayPal or PayPal-authorized credit card services, a 4.4% transaction fee will be deducted, as PayPal or PayPal-authorized credit card services does not refund this fee to us in case of a cancellation. For example, if you paid $100 via PayPal or PayPal-authorized credit card services and cancel at least 24 hours in advance, you will receive a refund of $95.60 after a $4.40 processing fee.
(2)No Refund: Cancellations made less than 24 hours before the tour start time, or failure to show up, will not be eligible for a refund.
Weather Conditions and Acts of God
Eastbound and Beyond operates tours in all weather conditions, including rain, snow, and sunshine. We advise you to dress appropriately and carry an umbrella if needed. In the event of extreme weather (e.g., hurricanes), we will offer to reschedule your tour to another available date. If rescheduling is not possible or preferred, we will provide a full refund.
Modification or Cancellation Due to Eastbound and Beyond
Eastbound and Beyond reserves the right to modify the date of any booking, or cancel a tour at any time. In either case, a full refund is available if the customer is unable to alter their dates.
Allergies & Dietary Requirements
We cannot guarantee the availability of special dietary options or the absence of potential allergens. While we strive to accommodate vegetarians and guests with food allergies, Eastbound and Beyond is not responsible for any allergic reactions or dietary restrictions. It is the sole responsibility of the customer to manage their own dietary needs.
Health & Safety
Eastbound and Beyond assumes no liability for participants' health, including but not limited to pre-existing conditions or any health issues that arise during or as a result of participation in our activities. While we will make every effort to assist in the event of a medical emergency, Eastbound and Beyond is not responsible for any associated costs or any resulting impact on your health.
Eastbound and Beyond reserves the right, at its sole discretion, to decline or remove any customer whose health or behavior disrupts the operation of an activity or affects the welfare or enjoyment of other participants.
Eastbound and Beyond is not responsible for any food or beverages consumed during its tours. We act solely as a consultant in arranging logistics, transportation, venue visits, and other services and do not assume liability for accidents, delays, injuries, loss, or damage caused by any company, organization, or individual involved in transportation, service provision, or tour arrangements. Additionally, we are not responsible for any incidents arising from the actions or negligence of restaurants, shops, or their employees.
Eastbound and Beyond is not responsible for exposure to COVID-19 or any other viruses in public places where people are present. By participating in a tour, you and all guests voluntarily assume all risks related to such exposure and agree not to hold Eastbound and Beyond, its contractors, employees, or affiliates liable. You also agree to take all necessary precautions to protect yourself and others, including but not limited to wearing a face covering, washing hands frequently, using hand sanitizer, and refraining from joining a tour if feeling unwell or exhibiting symptoms.
Pregnancy and Other Medical Conditions
Pregnancy is considered a medical condition and must be disclosed at the time of booking. We may refuse to carry women who are over 24 weeks pregnant and individuals with certain medical conditions if reasonable accommodations cannot be provided.
Insurance
Eastbound and Beyond strongly encourages all guests to obtain adequate health insurance before participating in any of our activities. Additionally, we recommend purchasing a separate travel insurance policy to protect yourself and your belongings while traveling.
Waiver and Release of Liability & Claims
By purchasing tickets for and/or participating in any activity offered by Eastbound and Beyond, you acknowledge, understand, represent, warrant, and agree to the following, with the understanding that Eastbound and Beyond will rely on these representations:
1. You voluntarily choose to participate in the activity offered by Eastbound and Beyond;
2. You are in good health and do not have any physical or mental conditions, illnesses, food allergies, or disabilities that would make you particularly susceptible to injury or harm while participating in the activity;
3. You fully understand and accept all risks associated with your participation, including but not limited to exposure to unfavorable weather conditions, food-related illnesses, injuries (such as those resulting from self-inflicted accidents, interactions with other participants, transportation incidents, or pedestrian hazards), and even the risk of death;
4. You grant Eastbound and Beyond the irrevocable, sublicensable right to use your name, likeness, photograph, and/or image for any commercial or non-commercial purpose, in any media now known or developed in the future, in perpetuity and worldwide, without any further obligation or compensation to you;
5. Your participation in the tours is solely at your own risk. On behalf of yourself and any person or entity claiming through or on your behalf, you hereby fully and unconditionally release and discharge Eastbound and Beyond, along with its affiliated entities, past and present employees, owners, officers, members, managers, partners, contractors, insurers, representatives, and agents (collectively, the “Released Parties”), from any and all claims, actions, damages, liabilities, losses, costs, and expenses arising from or related to your participation in the tours. This includes, but is not limited to, claims for death, injury, or loss or damage to you, others, or property, regardless of whether such injury, loss, or damage was caused by the negligence of Eastbound and Beyond or any of the Released Parties.
Furthermore, you agree to defend, indemnify, and hold harmless the Released Parties from any and all liabilities, claims, actions, damages, expenses (including, but not limited to, attorney’s fees), and losses of any kind arising from or related to your participation in the tours.
6. You waive any claims against Eastbound and Beyond and its representatives and agree not to seek compensation from them for any personal injury, illness, or death suffered by you, or for any loss of or damage to property, arising from your participation in the activity.
7. Eastbound and Beyond and its representatives shall not be responsible for any expenses or liabilities resulting from civil unrest, labor disputes, war or threats of war, acts of terrorism, government restrictions, adverse weather conditions, theft, fire, illness, or any other circumstances beyond their control.
8. You acknowledge that Eastbound and Beyond is not responsible for any food or beverages consumed during its tours. Eastbound and Beyond acts solely as a consultant in arranging tours, transportation, venue visits, and other services and does not assume liability for accidents, delays, injuries, loss, or damage caused by any company, organization, or individual involved in transportation, service provision, or tour arrangements. This includes, but is not limited to, the actions or negligence of any restaurant, shop, or their employees.
Right to Distribute Media
By participating in Eastbound and Beyond tours, you grant the Company an irrevocable, royalty-free, worldwide license to take photos and videos during its tours in which you may appear (the “Material”). The Company has the right to reproduce, distribute, broadcast, exhibit, edit, digitize, or otherwise use the Material in any form of media, whether currently existing or developed in the future. This includes, but is not limited to, incorporating the Material into the Company’s website, catalogs, books, brochures, magazines, or any other publications, as well as informational, commercial, promotional, or advertising materials.
This usage is strictly limited to the Company’s own business-related promotional purposes and cannot be transferred to third parties for commercial use or used for any purpose unrelated to the Company's travel business.
You acknowledge and agree that the Company shall be the exclusive owner of all rights, title, and interest in the Material, including any derivative works created from it, and holds the full copyright thereof.
Intellectual Property Rights
All intellectual property rights related to the website—including, but not limited to, text, graphics, software, photographs, images, videos, audio, trademarks, and logos—are owned by Eastbound and Beyond or its licensors. Except as expressly provided under these Terms of Use, you are granted only a limited, non-exclusive license to access and use the website for its intended purpose.
You acknowledge and agree that your use of the website does not grant you any ownership or other rights in relation to Eastbound and Beyond’s intellectual property or that of its licensors. Any unauthorized use, reproduction, distribution, or modification of the website’s content is strictly prohibited.
